Policy on Copyright Infringement
In accordance with the DMCA, NeedShirt.com has adopted the following policy regarding copyright infringement. We reserve the right to:
- Block access to or remove material that we believe in good faith to be copyrighted and unlawfully copied and distributed by any of our advertisers, affiliates, content providers, members, or users.
- Remove and discontinue service to repeat offenders.
Your use of NeedShirt.com services is always subject to our Terms of Use, which incorporate this Copyright Dispute Policy.
Procedure for Reporting Copyright Infringements
If you believe that content on NeedShirt.com infringes your copyright (or the copyright of someone you are authorized to act on behalf of), please submit a copyright infringement notice to our Designated Agent, containing the following:
(a) A physical or electronic signature of an authorized representative of the copyright owner; (b) Identification of the copyrighted work(s) being infringed; (c) Identification of the infringing material, including details that allow NeedShirt.com to locate and verify its existence; (d) Contact information of the notifier (address, phone number, email if available); (e) A statement asserting that the notifier has a good faith belief that the material is unauthorized; (f) A statement, under penalty of perjury, confirming the accuracy of the information and authorization to make the complaint on behalf of the copyright owner.
Actions Taken Upon Receipt of a Valid Copyright Infringement Notice
Upon receiving a proper copyright infringement notice, we reserve the right to: (a) Remove or disable access to the allegedly infringing material; (b) Notify the accused content provider of the removal or disabled access; (c) Terminate the content provider’s access if they are a repeat offender.
Procedure for Submitting a Counter-Notice
If a content provider believes that the removed material is not infringing or has authorization to post it, they may submit a counter-notice to our Designated Agent with the following details:
(a) A physical or electronic signature of the content provider; (b) Identification of the removed or disabled material and its location prior to removal; (c) A statement asserting good faith belief that the material was removed due to mistake or misidentification; (d) The content provider’s contact details (name, address, phone number, email if available) and a statement consenting to the jurisdiction of the Federal Court in their district or any jurisdiction where NeedShirt.com is located, agreeing to accept service of process from the original notifier.
If a valid counter-notice is received, NeedShirt.com may notify the original complaining party and restore the removed material within 10 to 14 business days unless the copyright owner files a legal action.
